Terms of Service

These Terms of Service ("Terms") govern your access to and use of Sculwave, including sculwave.com, Sculwave software, Minecraft integrations, server-administration tools, and real-time proximity voice chat.

SculWave is operated by Jinu JS, a sole proprietor based in Thiruvananthapuram, Kerala 695504, India ("SculWave", "we", "us", "our").

By using Sculwave, you agree to these Terms. If you do not agree, do not use the service.

1. The Sculwave Service

Sculwave provides technology that enables real-time proximity voice communication for supported Minecraft servers.

Sculwave primarily provides its paid service to Minecraft server administrators.

Players may use Sculwave voice chat without purchasing a subscription directly when the relevant Minecraft server administrator has enabled Sculwave and maintains an applicable subscription.

Sculwave does not own or operate the Minecraft servers on which the service may be used.

2. Independent Minecraft Service

Sculwave is an independent third-party service.

Sculwave is not affiliated with, sponsored by, endorsed by, or operated by Mojang Studios or Microsoft.

Minecraft and related trademarks belong to their respective owners.

Your use of Minecraft remains subject to the applicable Minecraft, Mojang, and Microsoft terms and policies.

3. Player Use

Players generally do not need a Sculwave account.

Sculwave may temporarily process a player's Minecraft gamertag and in-game position to provide authentication, session management, and proximity calculations.

Players are responsible for complying with the rules of the Minecraft server they are using.

4. Server Administrator Accounts

Server administrators may authenticate using Google.

Administrators are responsible for:

• maintaining account security;
• protecting their Google account;
• providing accurate account information;
• ensuring authorized use of their account;
• complying with applicable law; and
• activity conducted through their account.

Administrators must not impersonate another person or obtain unauthorized access to another account.

5. Server Administrator Responsibilities

Administrators are responsible for the Minecraft communities they operate.

Administrators are responsible for:

• establishing community rules;
• informing players of applicable rules;
• moderating their communities;
• handling player reports;
• using blocking tools responsibly;
• complying with applicable law;
• protecting their accounts;
• maintaining applicable subscriptions; and
• ensuring their use of Sculwave is lawful.

Sculwave provides technical infrastructure and does not assume responsibility for day-to-day moderation of individual Minecraft communities.

6. Player Conduct

Players must use Sculwave responsibly and comply with applicable law and the rules of the relevant Minecraft server.

Players must not use Sculwave to:

• threaten another person;
• harass or intimidate another person;
• engage in unlawful hate speech or discriminatory abuse;
• facilitate criminal activity;
• distribute malware;
• attack or disrupt infrastructure;
• attempt unauthorized access;
• bypass authentication or security;
• circumvent subscription controls;
• conduct fraud;
• impersonate another person; or
• otherwise violate applicable law.

7. Voice Communication

Sculwave provides real-time voice communication.

Sculwave does not intentionally record or permanently store player voice conversations.

By using voice chat, you acknowledge that:

• your voice may be transmitted to other participants;
• other participants may hear your communications;
• you are responsible for what you communicate;
• other participants may independently record communications; and
• Sculwave cannot control independent recordings made by other users.

8. Proximity Processing

Sculwave temporarily processes in-game Minecraft position information to calculate proximity between players.

This information is used to determine which players should be able to hear one another.

Sculwave does not use this information to determine a player's physical or real-world location.

9. Moderation and Blocking

Sculwave may provide server administrators with functionality allowing them to block or restrict players from using Sculwave voice chat.

Administrators may use these controls for violations including:

• hate speech;
• harassment;
• threats;
• discrimination;
• abusive behavior;
• spam;
• inappropriate behavior; and
• violations of server rules.

Sculwave does not promise to independently investigate every alleged voice-chat violation.

Because Sculwave does not intentionally record voice communications, we may not possess an audio recording capable of determining what was said.

Sculwave may nevertheless take action when information reasonably available to us indicates a violation of these Terms, applicable law, or a security requirement.

10. No General Voice Monitoring

Sculwave does not undertake to continuously listen to, review, or monitor player voice conversations.

Sculwave is a technical communication service and not a general-purpose voice-content monitoring service.

We may act on information brought to our attention, administrator reports, technical security information, or other information reasonably available to us.

11. Subscriptions

Sculwave offers paid subscriptions primarily to Minecraft server administrators.

The applicable price, billing period, features, and subscription terms are presented before purchase.

Subscriptions may automatically renew where recurring billing applies.

You are responsible for reviewing the applicable purchase information before completing a transaction.

12. Paddle

Sculwave uses Paddle to process applicable subscriptions and payments.

Paddle acts as Merchant of Record for applicable transactions processed through its platform.

Paddle may handle payment processing, applicable taxes, invoicing, subscription management, renewals, refunds, and related transaction functions.

Sculwave does not intentionally store complete payment-card information.

Paddle's own terms and policies may apply to transactions processed through Paddle.

13. Failed Payments

If a subscription payment fails, is reversed, disputed, charged back, or otherwise becomes unpaid, access to paid Sculwave functionality may be suspended or terminated.

Paddle may also apply its own payment-recovery procedures.

14. Cancellation and Refunds

Subscribers may cancel recurring subscriptions through the applicable subscription-management mechanism.

Unless otherwise required by applicable law or expressly stated at purchase, cancellation generally prevents future renewal but does not automatically refund amounts already paid.

Refunds may be handled through Paddle for transactions processed through Paddle.

Mandatory consumer refund, cancellation, cooling-off, or other statutory rights remain unaffected.

15. Subscription Changes

We may change subscription plans, features, or pricing for future purchases or renewals.

Where applicable law requires advance notice or other protections, we will comply with those requirements.

16. Suspension and Termination

We may suspend or terminate access where reasonably necessary because of:

• violation of these Terms;
• unlawful use;
• fraud;
• payment abuse;
• unauthorized access;
• security threats;
• attacks against infrastructure;
• material abuse of the service;
• attempts to circumvent subscription controls;
• significant operational risk; or
• legal requirements.

We may take immediate action where reasonably necessary to protect users, infrastructure, security, legal rights, or the service.

17. Service Availability

Sculwave depends on internet infrastructure, VPS hosting, networks, software, and third-party services.

We do not guarantee uninterrupted availability.

Service interruptions may occur because of:

• maintenance;
• software updates;
• VPS failures;
• network failures;
• hosting-provider outages;
• LiveKit failures;
• security incidents;
• internet outages;
• excessive demand;
• third-party failures; or
• circumstances outside our reasonable control.

18. Compatibility

We do not guarantee compatibility with every Minecraft version, server implementation, plugin, mod, proxy, client, hosting environment, or network configuration.

Compatibility may change when Minecraft or third-party software is updated.

19. Infrastructure Security

You must not interfere with Sculwave infrastructure.

You must not:

• attack Sculwave servers;
• conduct denial-of-service attacks;
• attempt unauthorized access;
• maliciously exploit vulnerabilities;
• overload infrastructure;
• bypass security mechanisms;
• access another user's information; or
• interfere with service availability.

20. Intellectual Property

Sculwave's software, website, branding, documentation, interfaces, and original materials are owned by or licensed to Jinujs.

You receive a limited right to use Sculwave for its intended purpose while authorized to use the service.

Except where permitted by law, you may not copy, redistribute, resell, modify, or otherwise exploit proprietary Sculwave materials without authorization.

21. User Communications

Sculwave transmits communications generated by users.

Users are responsible for their own communications and conduct.

Sculwave does not generally pre-approve or endorse user communications.

We may take appropriate action when information reasonably available to us indicates unlawful conduct, a violation of these Terms, a security threat, or another circumstance requiring action.

22. Third-Party Minecraft Servers

Sculwave does not own or operate participating Minecraft servers.

Server administrators may impose additional rules governing their communities.

Sculwave is not responsible for decisions independently made by server administrators, except where applicable law provides otherwise.

23. Third-Party Services

Sculwave may depend on third-party services including Google, Paddle, Bluehost, LiveKit, network providers, and other infrastructure providers.

Third-party services may have independent terms, privacy policies, outages, and limitations.

Sculwave is not responsible for failures caused solely by third-party services outside our reasonable control.

24. Privacy

Your use of Sculwave is also governed by the Sculwave Privacy Policy.

25. Age and Legal Capacity

You may use Sculwave only where you are legally permitted to do so.

Where applicable law requires parental or guardian consent or other safeguards based on age, those requirements must be satisfied.

Sculwave may restrict access where we reasonably believe applicable age or consent requirements have not been satisfied.

26. Disclaimer of Warranties

To the maximum extent permitted by applicable law, Sculwave is provided on an "as is" and "as available" basis.

We do not guarantee that Sculwave will:

• always be available;
• operate without errors;
• provide uninterrupted voice communication;
• work with every Minecraft configuration;
• maintain every feature indefinitely;
• provide a particular audio quality; or
• remain compatible with future versions of Minecraft or third-party software.

Nothing in these Terms excludes a warranty or consumer right that cannot legally be excluded.

27. Limitation of Liability

To the maximum extent permitted by applicable law, Jinujs will not be liable for indirect, incidental, special, consequential, exemplary, or punitive losses arising from or related to use of Sculwave.

This may include loss of profits, revenue, business opportunities, reputation, data, or service availability where such exclusion is legally permitted.

Where liability cannot legally be excluded, it will be limited to the maximum extent permitted by applicable law.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

28. Paid-Service Liability

To the maximum extent permitted by applicable law, where liability relating to a paid Sculwave subscription cannot otherwise be excluded, the maximum aggregate liability arising from that subscription will be limited to the amount paid for the affected subscription during the applicable period.

This limitation does not apply where applicable law prohibits such a limitation.

29. Indemnification

To the extent permitted by applicable law, server administrators are responsible for claims, losses, liabilities, damages, and reasonable costs arising from:

• unlawful use of Sculwave;
• violation of these Terms;
• misuse of an administrator account;
• infringement of another person's rights; or
• unlawful operation or management of their Minecraft community.

This provision applies only to the extent legally enforceable.

30. Force Majeure

Sculwave will not be responsible for delay or failure caused by circumstances outside our reasonable control, including major internet outages, hosting failures, infrastructure failures, cyberattacks, government actions, natural disasters, power failures, or other events outside our reasonable control.

31. Changes to Sculwave

We may modify, suspend, replace, or discontinue features of Sculwave for technical, security, legal, business, or operational reasons.

Where applicable law requires protections for existing paid subscriptions, we will comply with those requirements.

32. Changes to These Terms

We may update these Terms when necessary.

The updated version will be published on sculwave.com and the "Last Updated" date will be revised.

Where required by applicable law, we will provide additional notice.

33. Severability

If any provision of these Terms is found to be invalid or unenforceable, it will be enforced to the maximum extent permitted by law and the remaining provisions will continue in effect.

34. No Waiver

Failure to immediately enforce a provision does not constitute a permanent waiver of that provision or any other right.

35. Governing Law

These Terms are governed by the laws of India, subject to mandatory consumer protections and other laws applicable to users in their jurisdiction.

Nothing in this provision is intended to remove a mandatory legal right.

36. Informal Dispute Resolution

Before commencing formal proceedings, users are encouraged to contact SculWave at:

Nothing in this section prevents a person from exercising a mandatory legal right or contacting a competent authority.
